The longer the more the industry as well as the customers move towards outsourcing or the Cloud (which â€“ to me â€“ is a special case of outsourcing). If we look at the security impact of such moves, I guess that for most customers/enterprises it makes a lot of sense. IT and Security is often not the core competence of most industries â€“ but it will be of a Cloud provider or an outsourcer. So far, it is absolutely clear to me that a move to the public Cloud makes a lot of sense. If we look at the risks “only” from a technical/governance perspective, there is no doubt for me.
But now, there comes the legal situation. Since years there is a discussion about the impact of the Patriot Act. However, it is not only about the Patriot Act â€“ most governments know similar rules all across the Globe. However, the Patriot Act is addressing terrorism but with crimes, the situation does not get any better. As you have read in Why your data with a US cloud provider is at risk the legal situation about which government is allowed to access which data in a foreign country under which circumstances is unclear and changes from country to country and might even change from judge to judge.
And it is getting more complex: Our governments are often challenged to understand the broader impact of decisions: EU screams foul over Microsoft data privacy case… three years too late. We are living in a world full of legal uncertainties for a global and interconnected world. Uncertainty typically is a huge issue for companies to invest money and grow. It will be interesting to see, how the market here develops.
In my case, no critical information will leave Switzerland â€“ and in most cases my infrastructure as I do not see a real Cloud provider except Swisscom emerging in Switzerland. Putting data in the Swisscom â€“ our â€“ Cloud is definitely a way to go. This is based on our risk assessment. And one of the key reasons behind this is the legal uncertainties as well as the trust in foreign governments to really protect my infrastructure.
